Here is a practical guide to what every renter needs to know about Alberta tenant rights in 2026.


The Residential Tenancies Act (RTA)

The RTA is the provincial law that outlines the rules landlords and tenants must follow. It covers everything from security deposits and rent increases to maintenance and evictions. It is important to note that you cannot sign away your rights under the RTA; any clause in a lease agreement that contradicts the RTA is legally invalid.


Security Deposits: The Rules

A security deposit (often called a damage deposit) protects the landlord against unpaid rent or damage beyond normal wear and tear. Under Alberta law, there are strict rules regarding these deposits:


  • Maximum Amount: A landlord cannot ask for a security deposit that is greater than one month's rent.
  • Trust Accounts: Landlords must deposit this money into an interest-bearing trust account within two banking days of receiving it.
  • Return of Deposit: After you move out, the landlord has 10 days to return the deposit (plus any required interest) or provide a statement of account detailing any deductions for cleaning or repairs.


Rent Increases and Rent Control

One of the most frequent questions newcomers ask is about rent control. Alberta does not have rent control. Landlords are permitted to increase the rent by any amount, but they must follow specific rules regarding timing and notice:


  • Frequency: Rent cannot be increased until a tenant has lived in the property for at least one full year (365 days), and increases can only happen once every 365 days thereafter.
  • Notice Period: For a month-to-month tenancy, the landlord must provide three full tenancy months' written notice before the rent increase takes effect. For a fixed-term lease, the rent cannot be increased during the term of the lease.

The Landlord's Responsibility

Your landlord must ensure the property meets all minimum health and safety standards. This means they are responsible for major repairs, such as fixing a broken furnace, repairing a leaking roof, or resolving plumbing issues. They must keep the premises safe and habitable.


The Tenant's Responsibility

As a tenant, you are responsible for maintaining ordinary cleanliness and repairing any damage caused by you or your guests. You must also notify the landlord promptly when a repair is needed.


Notice of Entry

Your rental property is your home, and you have a right to privacy. A landlord cannot simply drop in unannounced. Under the RTA, a landlord must provide at least 24 hours' written notice before entering the property, and entry must occur between 8:00 AM and 8:00 PM (and not on a holiday or the tenant's day of worship). The notice must state the reason for entry, such as making repairs or showing the unit to prospective renters.
